TERMS & CONDITIONS USE OF LOCALLY CRAFTED GOODS & SERVICES AUSTRALIA
1.1 Onboarding Process
Please read these conditions carefully before registering for Locally Crafted Services. By registering for Locally Crafted Goods & Services Australia platform (Locally Crafted), you understand and agree to be bound by the following conditions.

1.1.1 FEES
1/ No set fee will be asked for setting up and maintaining your webpage on Locally Crafted Goods & Services Platform.
2/ No sales commission will be asked when customers derived from Locally Crafted Services purchases on your website. Unless your products are sold over Locally Crafted's Sales Channel.

1.1.2 MATERIALS
Images, logo and copy are used to drive traffic to your specified online location. Your images, logo and copy are used on the Locally Crafted website, its blogpost and social media platforms. Locally Crafted will use your images, logo and copy whenever it sees fit to single out your business, driving traffic to your designated online presence. If anything doesn’t fall within the ‘normal’ platforms to create visibility, credibility and/or advertising for your business, Locally Crafted will contact you in order to ask for your approval. We care about your brand and how it’s presented.
1.1.3 REGISTRATION FORM
The onboarding process is a 2-step process, that allows Locally Crafted Services to create your webpage without any further steps required from you, apart from reviewing your company page.

1.1.4
Registration Form submission is required to register for Locally Crafted Services, it provides us with the required information to set-up your profile. Contact details, blurb and your unique selling points are the most important facets, along with an elaboration of the sustainable elements within your business.
Not submitting a Registration Form does not start the support services of Locally Crafted.
Not submitting a Registration Form can lead to an unavailability under your specified product category when it is submitted later than expected. Locally Crafted works in sustainable ways and believes a fair contribution offering to Locally Crafted provides room for every business to grow through the platform. This implies two elements:
A/ Locally Crafted carefully assesses the market and the individual product categories. A result of this type of analysis implies limited spots are available per product category, in order to give each supported business a chance to grow and avoid flooding the market.
B/ Locally Crafted is here to support businesses by singling them out of the market and drive traffic to its online destination.

1.1.5
When your profile has been published, you will be notified with an email from Locally Crafted. Feedback on your profile, suggested changes and copy alterations can be submitted at any time, as it is important that your profile reflects your current product/service offering and business structure.
1.1.6 ONGOING SERVICES
At any appropriate time you can ask Locally Crafted Services to update your webpage, add different copy, alter online end destinations, add different social media platform links or change the hero-image. There is no limit on the number of revisions we will do for supporting your business. Locally Crafted will be transparent in workload and share with you an estimated date of publishing the required changes.

Please note that Locally Crafted Services can:
Rewrite your copy to reflect SEO keywords and key-phrases to boost visibility on the search engines and being able to have potential customers finding you via their search queries, we might need to reflect search queries within your copy.

Please be aware that:
SEO work is long-term focussed and usually starts driving traffic after 6 months.

Please be informed that:
At any time, a tag can be requested to be installed on your website to track and trace generated traffic. This is not compulsory although it allows us to give you appropriate data.
1.2 ’Fair’ Contribution (for manufacturers only)
Under a ‘fair’ Contribution we understand the following:

A Fair contribution reflects a validation of Locally Crafted efforts and the results coming from our efforts.

A/ creating your webpage,
B/ maintaining your webpage,
C/ on-site SEO,

E/ writing, uploading and sharing blog articles,
F/ providing a B2B portal,
G/ bringing you directly or indirectly in contact with other businesses to increase ongoing sales agreements and other services we see fit in supporting your business.
H/ creating awareness and visibility around your business and products or services via posting on our social media platforms

1.3 ’Fee' (for service providers only)
Under a ‘fee’ we understand the following:

A Fee is the half-yearly fixed contribution, paid to Locally Crafted Australia, reflecting
1/ segregation of your business from the entire market by being listed on a niche platform for local and sustainable businesses
2/ Locally Crafted efforts to increase visibility and credibility of your business and its services over a series of marketing tactics.

Efforts can be (but are not limited to)
A/ creating your webpage,
B/ maintaining your webpage,
C/ on-site SEO,
D/ off-site SEO,
E/ writing, uploading and sharing blog articles,
F/ providing a B2B portal,
G/ bringing you directly or indirectly in contact with other businesses to increase ongoing service agreements and other services we see fit in supporting your business.
H/ creating awareness and visibility around your business and products or services via posting on our social media platforms

1.4 General Terms & Conditions

1.4.1 PRIVACY
Please review our Privacy Policy, which also govern your use of Locally Crafted Goods & Services, to understand our practices.

1.4.2 ELECTRONIC COMMUNICATIONS
When you use any Locally Crafted Service or send e-mails, text messages, and other communications from your desktop or mobile device to us, you are communicating with us electronically. We will communicate with you electronically in a variety of ways, such as by e-mail, text. Or we will call you on one of your contact phone numbers. You consent to receive communications from us electronically and agree that communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

1.4.3 TRADEMARKS
Any logos, images, scripts, copy, videos made available to Locally Crafted Service, will be respected and used only for the purpose within Locally Crafted Service to support your business, create visibility and generate traffic to your website.
Locally Crafted Service takes the liberty to use logos, copy, images, videos and blog articles on any, some and all of his platforms without the need for any additional approval. For any other service, outside those mentioned above, Locally Crafted Service will ask specifically for your permission and will explain the reasoning behind the use.

1.4.4 YOUR WEBPAGE
You are responsible for keeping Locally Crafted Services posted about any changes in your business; from product/service changes, to social platforms, from ecommerce procedures to new features and unique selling points, as well as anything that is added, changed or removed from the sustainability within your business.
You must ensure that the details you provide to Locally Crafted via the Registration Form are correct and complete, and inform us of any changes. Locally Crafted will adjust any required and necessary changes as quickly as possible after it has been made aware of them.
If we have concerns with your webpage, or activity relating to your business, or if you are in breach of applicable laws, these Terms and Conditions, we reserve the right to take action and inactivate your webpage. The action we elect to take and any notice you may receive will vary depending on the Locally Crafted Service, the circumstances and our assessment of relevant factors. Suspension or termination of a Locally Crafted Service may occur in connection with, or result in suspension or termination of other Locally Crafted Services. At any time, you may, in accordance with the applicable Terms and Conditions and the use of the tools and settings we make available to you for each Locally Crafted Service, cease Locally Crafted support to your business. With a simple email, call or text to Locally Crafted contact details, your webpage will be removed. No refunds or any form of compensation can be requested from Locally Crafted Services. Locally Crafted will assess the timeframe between the moment of ceasing your support from Local Crafted and your last ‘fair’ contribution made out to Locally Crafted and will, in case it’s close to another fair contribution request, send out such a request for making out a fair contribution, reflecting the efforts Locally Crafted Services has made to support your business and the results your business saw from our efforts.
1.4.5 INTELLECTUAL PROPERTY CLAIMS
Locally Crafted respects the intellectual property of others. If you believe that an item or information on any Locally Crafted Service infringes your intellectual property rights, please contact us on info@locallycrafted.com.au.

1.4.6 OTHER BUSINESSES
Parties other than Locally Crafted operate stores, provide services, or sell products on this website and we provide links to the sites of affiliated companies and certain other businesses. We are not responsible for examining or evaluating, and we do not warrant or accept any responsibility or liability for the actions or offerings of, any other party or the content of their websites. You should carefully review their privacy statements and other conditions of use.

1.4.7 LOCALLY CRAFTED'S ROLE
Locally Crafted, supports third party sellers to list their business and products on locallycrafted.com.au. The relevant seller is indicated on the respective company detail page. While Locally Crafted helps facilitate traffic to the client’s desired online presence, Locally Crafted is neither the buyer nor the seller of the seller's items. Locally Crafted provides a platform for sellers to present their business and goods and services. Accordingly, the contract formed at the completion of a sale for these third party products and services is solely between the buyer and seller. Locally Crafted is not a party to this contract nor assumes any responsibility arising out of or in connection with it nor is it the seller's agent. The seller is responsible for the sale of their products and for dealing with any buyer claims or any other issue arising out of or in connection with the contract between the buyer and seller.

1.4.8 DISCLAIMER AND LIABILITY
Unless otherwise specified in writing, Locally Crafted Services disclaims, and does not make, any representation or warranty of any kind in respect of the Locally Crafted Services including without limitation any representation or warranty (i) that they are free of viruses or other harmful components; (ii) that your use of the Locally Crafted Services will be uninterrupted or error-free; or (iii) as to the suitability or availability of the Locally Crafted Services.
Locally Crafted will not be responsible for: (i) losses arising from the unavailability of, or your inability to use any Locally Crafted Services), (ii) losses that are not directly caused by any breach on our part; (iii) any business loss, loss of sales, profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure; (iv) any indirect or consequential losses; (v) any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control.

1.4.9 APPLICABLE LAW
The laws of Victoria govern this Agreement and any dispute of any sort that might arise between the parties. Any dispute relating in any way to these Terms and Conditions, Registration Form and/or Locally Crafted Services, will only be adjudicated in the courts of Victoria. Each party consents to the exclusive jurisdiction and venue in these courts. Notwithstanding the foregoing, either party may seek injunctive relief in any state, federal, or national court of competent jurisdiction for any actual or alleged infringement of such party's, its affiliates' or any third party's intellectual property or other proprietary rights.

1.4.10 LOCALLY CRAFTED SERVICES
We reserve the right to cease providing any Locally Crafted Service to you, to discontinue any Locally Crafted Service and to make changes to any Locally Crafted Services at any time. Your access to Locally Crafted Services may be suspended or restricted in accordance with these Terms and Conditions, and as necessary for our business operations including without limitation to allow for repairs, maintenance or the introduction of new features or services.

1.4.11 AMENDMENTS
We reserve the right to make changes to any Terms and Conditions at any time by posting the changes on our website. You will be subject to the Conditions of Use and Service Terms made available on the website at the time that you use the Locally Crafted Services. You may at any time, cease using any Locally Crafted Services, terminate your account or the relevant Locally Crafted Service (in accordance with Section 4) including in the event of any such change.

1.4.12 SEVERABILITY
If any of these Terms and Conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

If you breach these Terms and Conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms and Conditions.

1.4.14 CHILDREN
Locally Crafted Services does not facilitate products for purchase by children. Locally Crafted Services supports children's products for purchase by adults. If you are under 18 you may use the Locally Crafted Services only with the involvement of a parent or guardian.
